1. Competition/s Terms & Conditions
1.1. Waterfall Mall competitions are open to residents of the Republic of South Africa and surrounding countries, providing winners supply official identification upon the collection of prizes. The entrant cannot be a juristic person and must be an individual.
1.2. No person may, enter any competition hosted partly or in whole by Waterfall Mall or on behalf of a third party. All entries must be made personally by the entrant.
1.3. The judges’ decision is final, and no correspondence will be entered into.
1.4. Competitions are conducted by Waterfall Mall being Growthpoint Management Services Proprietary Limited (“the promoter”).
1.5. No person who is a director, employee, agent of or consultant to the Promoter or Supplier of goods and services with respect to the relevant competition or who is a spouse or life partner to the Promoter or Supplier is eligible to participate or enter Waterfall Mall competitions.
1.6. Entrants below the age of 18 (eighteen) must obtain their parent’s or guardian’s consent before entering the competition.
1.7. Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, the case may be, created for either the entrant or the promoter in terms of the Consumer Protection Act. 68 of 2008 (“the CPA”).
1.8. The entrant acknowledges that by submitting his or her entry to the competition he/she has been given an appropriate opportunity to first read these terms and conditions before entering and he/she understands and agrees to the terms and conditions. By entering the competition, the participant accepts full terms, conditions and rules of the competition.
1.9. All entrants to this competition participate entirely at their own risk. By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the promoter, and all entities
within the Growthpoint group; their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any indemnified party.
1.10. No liability is accepted for any loss or damages relating to the use of this site and the reliance of information contained in it.
1.11. Waterfall Mall and the promoter reserves the right to amend the terms and conditions as well as terminate the competition at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the competition and acknowledge that they will have no recourse against Waterfall Mall., the promoter or the owner, its advertising agencies, advisors, suppliers and nominated agents.
1.12. By entering the promotion in accordance with its terms, you are entering a promotion for the purposes of the Consumer Promotion Act, 2008 (“CPA”) and the promotion will be conducted in accordance with the relevant provisions of the CPA.
1.13. Any violation or attempt to violate any of the above rules will result in the immediate disqualification of the transgressor.

2. Prize/s Terms & Conditions
2.1. All prize/s are not transferable, not negotiable, and not redeemable for cash.
2.2. Prize winners will be contacted either telephonically, via email or social media by the marketing department of Waterfall Mall.
2.3. Prizes not collected/claimed within 30 (thirty) days of being won will be disposed of at Waterfall Mall’s discretion.
2.4. Prize claims may only be done Monday – Friday and during office hours (08h30 – 16h30).
2.5. Winners are advised to make an appointment with the Marketing Manager of Waterfall Mall to ensure that he/she has all the necessary documentation at hand to claim his/her prize.
2.6. In instances whereby the prize is cash, the winner will be required to submit a copy of his/her ID document and a letter from his/her bank confirming banking details. Where letters are unattainable, a stamped bank statement will be
accepted. The letter and/or bank statement must clearly show the bank’s stamp.
2.7. Payment of cash can take more than 30 (thirty) days after the required and correct documents are submitted and submissions must be before the 20th of a month to have the money paid by the end of the following month.
2.8. Where prizes have been sponsored to Waterfall Mall, the promoter will not accept any liability resulting from the sponsored prize.
2.9. Beware of fraudulent callers and SMS notifications that say you’ve won with Waterfall Mall. Here’s how you can check for fraudulent notifications:
2.9.1. You will NEVER be contacted by SMS if you are a winner. You would usually be contacted via email, telephonically or social media to visit the Waterfall Mall marketing/management offices for more information or to claim your prize.
2.9.2. Unless pre-arranged with you, Waterfall Mall representatives will NEVER unexpectedly come to your office or home to say you’re a winner or to deliver a prize as all/any delivery costs are usually to be absorbed by the winner.
2.9.3. If anyone phones to say you’ve won a prize in a Waterfall Mall competition, make sure you entered it. If anyone calls to say you’ve won a competition you did not enter with Waterfall Mall, it is NOT one of our representatives.
2.9.4. If in ANY doubt, ask the caller for their full name and Waterfall Mall switchboard number to verify.
2.9.5. If you are concerned that a fraudulent caller has contacted you, please store the number of the caller (if you have caller ID) and contact Waterfall Mall Centre Management immediately on 014 537 3600.
